Driver Terms of Service

1. Service Provider Agreement

This agreement ("Agreement") is entered into between you ("Driver") and LagosGarage Technologies Limited ("Company"). By accepting this Agreement, you agree to provide transportation services on the LagosGarage platform as an independent contractor, not as an employee.

2. Weekly Advance Payment Structure

LagosGarage operates on a weekly advance payment model. Under this arrangement:

• Drivers receive payment at the beginning of each service week
• Payment is calculated based on an assumed 4-5 runs per day for 6 working days
• The advance payment covers the entire week's expected service delivery
• Payment amounts are determined by the assigned route and current fare rates

By accepting advance payment, you are contractually obligated to complete all scheduled runs for that payment period. This is not optional compensation - it is payment for services you must render.

3. Service Obligations

Upon accepting advance payment, the Driver agrees to:

• Complete all scheduled runs for the paid week (minimum 4 runs per day, 6 days per week)
• Arrive at designated departure points on time
• Maintain the assigned vehicle in safe, clean, and operational condition
• Verify all passenger tickets using the LagosGarage verification system
• Follow designated routes without unauthorized deviations
• Provide professional, courteous service to all passengers
• Report any incidents, delays, or issues immediately to LagosGarage dispatch

4. Consequences of Non-Performance

Failure to provide the services for which advance payment has been received will result in:

• Pro-rata Clawback: Unearned advance payments will be recovered from future payments or through direct collection
• Service Suspension: Immediate suspension from the LagosGarage platform pending review
• Termination: Repeated non-performance will result in permanent termination
• Legal Action: LagosGarage reserves the right to pursue legal remedies for recovery of advance payments and damages
• Credit Reporting: Outstanding debts may be reported to credit bureaus

5. Excused Absences

The following circumstances may qualify for excused absence without penalty, subject to LagosGarage approval:

• Medical emergencies (with documentation)
• Vehicle breakdown (must be reported immediately with evidence)
• Accidents or road closures beyond driver control
• Family emergencies (immediate family only, with documentation)

Excused absences must be communicated to LagosGarage within 2 hours of the scheduled service time. Drivers must provide substitute coverage where possible or the corresponding portion of advance payment will be deducted from future payments.

6. Driver Requirements

To participate in the LagosGarage driver program, you must:

• Hold a valid Lagos State commercial driver's license
• Be at least 25 years of age
• Pass background and driving record checks
• Complete LagosGarage driver training and certification
• Maintain required insurance coverage
• Submit to periodic vehicle inspections
• Maintain a minimum driver rating of 4.0 out of 5.0

7. Vehicle Standards

Vehicles used on the LagosGarage platform must:

• Meet LagosGarage vehicle specifications and standards
• Be less than 10 years old
• Pass quarterly safety inspections
• Display LagosGarage branding as required
• Be equipped with functioning air conditioning
• Maintain cleanliness standards at all times

8. Prohibited Conduct

The following conduct is strictly prohibited and will result in immediate termination:

• Operating under the influence of alcohol or drugs
• Soliciting passengers outside the LagosGarage platform
• Accepting cash payments directly from passengers
• Discriminating against passengers
• Engaging in verbal or physical harassment
• Reckless driving or traffic violations
• Falsifying trip records or verification
• Unauthorized use of passenger data

9. Termination

Either party may terminate this Agreement with 7 days written notice. LagosGarage may terminate immediately for cause, including violation of these terms. Upon termination, any unearned advance payments must be returned within 14 days. Outstanding balances may be pursued through legal channels.

10. Indemnification

Driver agrees to indemnify and hold harmless LagosGarage, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from Driver's operation of vehicles, violation of laws, or breach of this Agreement.

11. Governing Law

This Agreement shall be governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved through arbitration in Lagos, Nigeria.
